Course Objective
Update Law Enforcement concerning the Illinois Firearms Restraining Order Act.
Course Content
On January 1, 2019, Public Act 100-0607 created the Illinois Firearms Restraining Order Act. That Act provided that a petitioner may request an emergency lethal violence order of protection by filing an affidavit or verified pleading alleging that the possessor of a firearm poses an immediate and present danger of causing personal injury to himself, herself, or another by having in his or her custody or control, owning, purchasing, possessing, or receiving a firearm. Further, the Act provided that either a family member of the firearm possessor or a law enforcement Officer may file a petition to obtain this order. Additionally, if a Court issues this emergency order, it will also issue a search warrant which will require the seizure of the possessor’s firearms by law enforcement officers. Additionally, the Illinois Legislature has enacted Public Act 102-0345. That public act requires all Illinois law enforcement officers receive an annual training program that trains officers on the use of firearms restraining orders, how to identify situations in which a firearms restraining order is appropriate, and how to safely promote the usage of the firearms restraining order in different situations. This presentation was created to provide that training.
